Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Krestrel ("we", "us") governing your use of the Krestrel mobile app and this website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Important — not medical advice. Krestrel is a record-keeping and organization tool for caregivers. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional medical judgment. Nutrient figures shown in the app are USDA reference values. Never disregard or delay professional medical advice because of something in the app. In an emergency, call your local emergency number. Always consult your child's qualified healthcare provider about medical conditions, medications, diet, and care decisions.

1. Who may use the Service

You must be at least 18 years old and the parent or legal guardian of the child whose information you enter. By using the Service you represent that you meet these requirements and that you have the authority to provide the information you enter and to invite any additional caregivers.

2. Your account

You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
You are responsible for activity that occurs under your account, including caregivers you invite into your care circle and the level of access you grant them.
Notify us promptly if you believe your account has been accessed without authorization.

3. Acceptable use

You agree not to: use the Service unlawfully or for anyone other than a child you are authorized to care for; attempt to access data belonging to other accounts; reverse-engineer, disrupt, or overload the Service; or upload content that infringes others' rights or that you have no right to store.

4. Your content

You retain ownership of the information you enter ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to operate the Service for you and the caregivers you authorize, as described in the Privacy Policy. You are responsible for maintaining your own copies of information that is important to you.

5. Care circle & sharing

The Service lets you invite other caregivers and grant them access to a child's records. You control who is invited and what they can do. Removing a caregiver revokes their access going forward. Be thoughtful about whom you invite — they will be able to see the records you share with them.

6. Availability & changes

We may update, suspend, or discontinue features of the Service. We aim to give reasonable notice of material changes but are not liable for modifications or temporary unavailability. We may update these Terms; material changes will be reflected in the "Last updated" date and, where appropriate, announced in the app.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY CALCULATION OR REFERENCE VALUE IS ACCURATE OR APPROPRIATE FOR YOUR CHILD'S SITUATION.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

9. Termination

You may stop using the Service and delete your account at any time from Settings → Danger zone. We may suspend or terminate access if you violate these Terms or to protect the Service and its users.

10. Apple App Store terms

If you download the app from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use must also comply with the Apple Media Services Terms and the standard Licensed Application End User License Agreement (EULA), which apply to the extent they are not superseded by these Terms.

11. Governing law

These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law rules. Disputes will be resolved in the courts located there, unless applicable consumer-protection law provides otherwise.
